Default rear suspension height difference side to side (pics)

I noticed that I was having some exessive tire wear at the rear, so I decided to check the alaignment out. While checking the camber it was obvious that the ride height on the passenger side was lower than the drive side by about an inch. Not sure what is wrong. Everything looks to be in place back there. No broken sway bars/links, Shocks are attached, spring pads are there. Subframe bushings look ok... same on both sides. The passenger side spring looks like it's bake a little more... pushing up the sides of lower pad. But the height at the spring looks the same... 150mm including the pad.
If this is the problem, how do I move the spring back? What keeps it in the right place?

This is what it looks like from the differential point of view.

I think it's supposed to be like that. They do this so when the driver gets in the car it lowers the drivers side of the car to the height of the passenger side. I read about this on bf.c a few years ago. I'm sure somebody can elaborate on this for me or correct me if i'm wrong.

Mr. Bentley says 10mm max difference per side for other e36's. I think this is much more. Anyway, is there a way to adjust this?
