Hello fellow Ti owners,
I have very sad news to report. After having my 95 ti sport for only 15 months, some girl has felt the need to ram into the car from the back. Normally this isn't a problem insurance companies are there to fix these things, but this infidel has decided in their infinite wisdom to not have insurance. My insurance will not cover because it wasn't collision and the underinsured is only for bodily damage. Its been hit pretty bad in the rear end, most damage is underneath. I would show pictures but I haven't seen the car since the accident. The wheel is severly damaged, the rear drivers side quarter is pushed in, the bumper flew off. The wheel is also cocked in, so the rear axles must be bent, and the suspension has to be tweaked at least a little. If you stick the car in gear, it will not move. I'm guessing the damage is going to be at least $4000. I plan on filing a lawsuit against the girl and her parents, but what would you do with the car??
1) fix it
2) part it out
3) sell it as is
The car has 140,000 miles but runs very well. Interior is very close to mint except for the wear marks on the drivers seat from getting in and out (the leather is cracking some) and the clear coat on the hood is starting to come off some. Other than that, the car is in very good shape. Any direction on this would be appreciated. Are there any lawyers out there that could help. I'm from Pa, the accident was in NJ with a Jersey driver (no surprise on that one). Im really sorry about your car man. What i would do it sue the piss out of this girl and her family for the damages of your car and since your in severe pain (and for the rest of your life) collect some for your damages. Take that money fix you car and while they are fixing it just do a m3 swap while you at it i mean they will have the car in peices might as well do the swap at the same time. I mean if the car is that bad i guess you could just buy a m3 but i would stick with the Ti.... I would first, obviously sue her, but I think you have that down. Second, I would part it out. BMW parts are pretty expensive on ebay, and some boards, and what not. You could probably make about another $2k or so off of that. Then pour the $2k, along with whatever you get out of the lawsuit, into a new TI. __________________

God i hate insurance companies. did you say they won't pay because it wasn't collision? how is it NOT collision? did you have coverage for both under and un-insured? when you're looking into suing the girl and her family, i would have the lawyer check your insurance company while you're at it. they're sure happy to take your money, but it takes a pry bar to get any back out. LAME.
first, suing the girl and her family, even if successful, will take a good amount of time and who knows when you'll actually get any cash in hand (even if the settlement is in your favor). keep this in mind.
second, with the damage you described, i would part it out and look for another car (another ti if you like them - there was even a guy selling a ti on here from PA). when a car is hit like that, it is NEVER the same. look for another car that's never been in an accidnent and start over. hopefully you can get a decent amount parting it out (which will again take time). consider adding the additional insurance coverage you didn't have before (if you indeed don't have it already).
hopefully you have some other means of getting around because i don't think any of this is getting solved or getting money into your hand in short order. sorry this has happened to you and i hope everything turns out in your favor in time. good luck! __________________ 1996 318ti, California package, 267k miles

LAME. | Sorry to hear about the bad news. I hate irresponsible people who cant insure their vehicle like they are suppose to. I think they should lose their license for good and never be able to drive again. Under and Uninsured motorist coverage does not provide coverage to fix your car. It provides bodily injury to you to fix you if you get hit by an un/underinsured motorist. My allstate uninsured motorist has payed for two cars hit by uninsured twits...
In Oregon they have to.... Uninsured motorist is personel and property damage coverage.

Thanks for all the replies. I went to see the car today and while I was pulling out my amplifiers I got a call from the girl saying that her father had switched her insurance companies without her knowing it. The claim is now in the process of being taken care of. I really do hope they total it, its gonna be close. I've taken some pictures, I just have to figure out how to post them.
